1. Definitions

"Listing" means any advert, description, image, or related content posted on the Site.

"Service" means the online marketplace, directory, and related features offered by Anchor Exchange.

"Content" means all text, images, data, files, or media uploaded, transmitted, or displayed by a User.

2. Acceptance of Terms

By creating an account or using the Site, you:

• Acknowledge you are at least 18 years old and legally capable of entering into binding contracts;
• Agree to comply with this Agreement, our Privacy Policy and Cookie Policy;
• Accept that we may amend these Terms at any time by posting an updated version on the Site.

Your continued use of the Site after changes are posted constitutes acceptance of the revised terms.

3. Our Role

Anchor Exchange is not a broker, dealer, or intermediary.

We act solely as an advertising and listing platform where Users can post and browse items and services. We do not verify listings, guarantee sales, or mediate disputes. All transactions are strictly between Users.

You are solely responsible for verifying the accuracy, legality, and legitimacy of any advert, buyer, or seller you deal with.

4. User Accounts and Security

Some services require registration. You agree to:

• Provide accurate, current information;
• Keep your login credentials confidential;
• Accept responsibility for all activities under your account.

You may close your account at any time by contacting support. We may suspend, restrict, or terminate your account if you breach these Terms.

5. Fees, Payments, and Refunds

• Fees are payable in GBP (£) via approved payment methods (e.g. Stripe).
• Unless otherwise stated, all fees are non-refundable once a listing is published.
• Refunds may be considered only in cases of system error or duplicate billing.
• Users are responsible for all applicable taxes (e.g. VAT).
• “We reserve the right to change pricing, features, or payment methods with reasonable notice via email or on the Site. Continued use after notice constitutes acceptance of the changes.”

6. Advertising and Listings

When posting an advert or listing, you agree that:

• You are legally entitled to sell or promote the item or service;
• Each listing refers to one distinct item, vessel, or service;
• Your content is truthful, accurate, and not misleading;
• You will not post spam, duplicate listings, or irrelevant content;
• You will not include website addresses, contact details, or external links in basic/free adverts unless permitted.

We reserve the right to edit, reject, or remove any advert that breaches these rules or UK law.

7. User-Generated Content & Licence

By submitting content to Anchor Exchange, you:

• Retain ownership of your materials;
• Grant us a worldwide, non-exclusive, royalty-free licence to use, host, modify, display, reproduce, and distribute your content solely for operating and promoting the Site;
• Confirm that your content does not infringe the rights of any third party.

You agree that deleted listings may persist in backup systems or search archives for a limited time.

8. Prohibited Content and Conduct

You must not upload, post, or transmit any material that:

• Is false, misleading, defamatory, or unlawful;
• Infringes copyright, trademark, or intellectual property rights;
• Contains malware, viruses, or harmful code;
• Harasses, abuses, or discriminates against others;
• Promotes illegal or dangerous activities;
• Attempts to scrape, index, or harvest data from the Site using automated tools.

9. Data Protection and Privacy

Your personal data is handled in accordance with the UK GDPR and the Data Protection Act 2018.

10. Access and Interference

13. Liability and Indemnity

You acknowledge that:

• Anchor Exchange provides its services "as is" and "as available" without any warranty;
• We do not guarantee uptime, continuous access, or error-free operation;
• We are not responsible for the conduct, statements, or transactions of Users.

To the maximum extent permitted by law, we will not be liable for:

• Any indirect, incidental, or consequential losses;
• Loss of profits, business, or data;
• Any claim arising from your use of the Site or reliance on its content.

You agree to indemnify us against any claims, damages, or expenses arising from your breach of this Agreement or misuse of the Site.

14. Termination

We may, at our discretion:

• Suspend or delete your account;
• Remove or refuse to display any listing;
• Restrict your access to all or part of the Site.

If your account is suspended or terminated due to a breach of these Terms, you will not be entitled to any refund for unused time or listings.

15. Links to Third-Party Sites

The Site may contain links to external websites. We do not control or endorse these sites and accept no responsibility for their content or privacy practices.

16. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Both parties agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from these Terms.
